Legal framework for the use of our educational services and digital offerings

1. Scope and Subject of the Contract

These Terms of Use govern the legal relationship between LernErgo GmbH (hereinafter "Provider") and the users of the platform schoolstandingdesk.com as well as all related services for promoting ergonomic learning environments.

The subject of the contract is the provision of information, training materials, and consulting services in the field of ergonomic educational programs. The Provider does not offer medical or therapeutic services, but exclusively pedagogical and ergonomic specialist information.

2. User Obligations and Code of Conduct

The user undertakes to use the offered content exclusively for personal educational needs. Any commercial reuse or duplication requires the written consent of the Provider.

  • No manipulation of the technical infrastructure or security systems
  • No distribution of content that violates applicable law
  • Truthful information during registration and use
  • No automated data extraction or scraping procedures

In the event of violations of these obligations, the Provider reserves the right to block access and take legal action.

3. Limitation of Liability and Warranty

The Provider assumes no liability for the completeness, timeliness, or accuracy of the ergonomic recommendations provided. The content serves general information purposes and does not replace individual professional advice from qualified occupational therapists or occupational health physicians.

Liability for damages arising from the use of the platform is limited to intent and gross negligence. For slight negligence, the Provider is only liable in the event of a breach of essential contractual obligations (cardinal obligations).

3.1 Technical Availability

The Provider strives to ensure the services are available as uninterrupted as possible. However, one hundred percent availability cannot be guaranteed, particularly during maintenance work or technical disruptions beyond the Provider's control.

4. Data Protection and Data Security

The collection, processing, and use of personal data is carried out in accordance with the privacy policy, which is available at policy.html. The user consents to the processing of their data for the purpose of providing the educational services.

The Provider takes appropriate technical and organizational measures to ensure the security of the data. These include encryption technologies and regular security audits.

5. Rights to Content and Intellectual Property

All content published on the platform, in particular texts, graphics, logos, and training materials, is protected by copyright. The trademark "LernErgo" and the design of the platform are the property of the Provider.

The user receives a simple, non-transferable right of use for personal purposes. Any use beyond this, in particular public reproduction or editing, is prohibited without express consent.

6. Changes to the Terms of Use

The Provider reserves the right to change these Terms of Use at any time with effect for the future. Users will be informed of material changes by email to the address provided during registration.

If the user does not object to the changed terms within four weeks of receiving the change notice, the new terms are deemed accepted. The user will be informed of this deadline and the significance of their silence in the change notice.

7. Termination of Use

The user may stop using the platform at any time without stating reasons. The Provider may block access without notice in the event of violations of these terms or suspicion of unlawful use.

After termination of use, the user's personal data will be deleted in accordance with statutory retention periods, unless legal obligations require further storage.

8. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of performance and exclusive place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the Provider.

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid regulation shall apply that comes closest to the economic purpose of the invalid provision.
